1. Promotion Description

The Berrics x Amazon Explore 2021 Giveaway (the “Giveaway”) starts on December 13, 2021 at 09:00 a.m. PST and ends on December 16, 2021 at 09:00 a.m. PST (the “Promotional Period”).By participating in the Giveaway, each entrant unconditionally accepts and agrees to comply with and abide by the Giveaway terms and conditions herein (“Rules”), the relevant Website Terms of Use and Privacy Policy together with the decisions of The Berrics Company LLC (“The Berrics” or “Sponsor”), which shall be final and binding in all respects. The Berrics is responsible for the collection, submission or processing of entries and the overall administration of the Giveaway. Entrants should look solely to The Berrics with any questions, comments or problems related to the Giveaway. This Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram.

2. Eligibility

Open only to legal residents of the fifty (50) United States and the District of Columbia, who are 16 years or older, excluding Rhode Island, that have an Amazon.com account. Amazon.com accounts are free. However, entry is void where contrary to, prohibited or restricted by local law where that entrant is legally residing at the material time. Employees (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Sponsor, Hypebeast, Amazon Explore, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies (the “Promotion Entities”) are not eligible to enter or win.

3. How to Enter

To enter the Giveaway, you’ll first need to become a register user of www.Instagram.com (“Instagram”) or log into your Instagram account. If you do not have an account, go to www.Instagram.com to create one. Instagram accounts are free. By submitting your information and creating an Instagram account, you agree to the Instagram Terms of Use and Privacy Notice. If you do not agree to such Terms of Use and Privacy Notice, you cannot create an Instagram account, or participate in this Giveaway. Additionally, to enter via Instagram, your account must be set to public. To enter via Instagram, follow @berrics and @amazon_explore on Instagram, locate the post advertising the Giveaway (the “Post”), tag three (3) friends in the comments of the Post; and correctly answer all questions in the Post’s caption as determined by The Berrics (the “Submission”)

Each Submission must meet the following “Submission Requirements” (any Submission that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified):

• Submission must NOT contain any material that infringes or violates any right of a third party including copyright, patent, trademark, trade secret or other proprietary rights
• Submission must NOT contain subject matter which is, or could be considered, in the sole discretion of the Promotion Entities, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), defamatory, libelous, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., illegal gambling, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, hateful, degrading, harassing, or otherwise unlawful, tortious or objectionable;
• Submission must NOT contain any content that promotes any particular political agenda or message;
• Submission must NOT communicate messages or images inconsistent with the positive images and/or goodwill to which Promotion Entities wishes to associate;
• Submission must NOT violate any law;
• Submission must NOT contain any derogatory references to any of the Promotion Entities.

Limit one (1) entry per person and/or per social media account/email address. Entries received from any person or email address in excess of the limitation stated will be void. All entries must be submitted before the end of the Giveaway Promotional Period in order to participate. The Berrics’ database clock will be the official time keeper for this Giveaway.

4. Winner Selection

Seven (7) potential winners will be selected in a random drawing held on or about December 16, 2021 from all eligible entries received by The Berrics. Odds of winning depend on the number of eligible entries received.

5. Winner Notification

Potential winners will be notified by direct message via Instagram and/or comment on their Submission or by e-mail (depending on method of entry) and must reply by email or as otherwise directed by The Berrics within 24 hours of notification and acknowledge acceptance of the prize as directed by The Berrics. Potential winners may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within 10 days of date of issuance. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, The Berrics is unable to contact a potential winner or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected.

6. Prizes

Each Prize consists of one (1) ticket to attend the Amazon Explore x Tony Hawk Live Virtual Experience, a goodie bag containing one (1) autographed Birdhouse Deck, one (1) Birdhouse T-shirt in size L, one (1) pair of Vans Sneakers, one (1) pair of Birdhouse Socks, one (1) Berrics Zip Up hoodie in size L, and one (1) Berrics beanie.. Each Prize in total has an estimated retail value of: $700 USD.

Only one (1) prize per person and per household will be awarded. Prize are awarded “as is” with no warranty or guarantee, either express or implied by The Berrics. Prizes cannot be transferred, redeemed for cash or substituted by winner. The Berrics shall communicate the details for attending the Live Virtual Experience to the selected winners in the aforementioned notification. The remaining portions of each Prize will be delivered to the winners within 4-6 weeks after the Live Virtual Experience (except where there is delay in prize logistics and shipment arrangement that are out of The Berrics’ control). The Berrics reserves the right in its sole and absolute discretion to award a substitute prize if a prize described in these Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The Berrics makes no representation or warranty concerning the appearance, condition, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. The Berrics will not replace any lost or stolen prize items. Prize will only be awarded and/or delivered to physical addresses. P.O. Box address are not permitted or accepted. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the selected prize winner. Failure to comply with any of these Rules will result in forfeiture of the prize.

7. Privacy

All entrants acknowledge that if they are chosen as a winner, certain personally identifying information may be disclosed to third parties at least as required by law, including, without limitation, on a winner’s list. All personal information submitted as part of the Giveaway will be used in accordance with The Berrics’ online privacy policy (https://theberrics.com/privacy).

Any personal information that entrants share with The Berrics and Amazon will be kept secure and used as per the Rules and aforesaid privacy policy. Entrants agree that all submitted information may be used by The Berrics and Amazon to administer this competition. For competition entries and opt-in to receive marketing communications from The Berrics, the Data Controller (as defined under applicable data protection legislation) is The Berrics (for further information, please refer to the privacy policy of The Berrics - https://theberrics.com/privacy).

8. Limitation of Liability

The Berrics is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error, which may occur in the processing of submissions in the Giveaway. The Berrics assumes no responsibility for any misdirected or lost mail, or any error, omission, interruption, deletion, defect, delay of operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries.

In the event of a dispute concerning who registered online to participate in the Giveaway, the registration will be declared to have been made by the authorized account holder is defined as the natural person who is assigned to an email address by an internet provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide The Berrics with proof that the potential winner is the authorized account holder of the email address. If a dispute cannot be resolved to The Berrics’ satisfaction, the entry will be deemed ineligible.

9. Additional Terms

We may, to the maximum extent permitted by applicable law and in our sole discretion, change these rules or cancel the Giveaway at any time; or modify, terminate, or suspend the Giveaway should viruses, worms, bugs, unauthorized human intervention or other causes beyond our control corrupt or impair the administration, security, fairness or proper play of the Giveaway or submission of entries. We are not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Giveaway; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to your or any other computer resulting from downloading any materials in connection with the Giveaway. We may, in our sole discretion, disqualify any individual found to be: (x) tampering with the entry process or the operation of the Giveaway or website; (y) acting in violation of these rules; or (z) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. If your entry is incomplete or if you use robotic, automatic, programmed or similar entry methods, your entry will be void. The authorized subscriber of the e-mail address associated with any account used to enter the Giveaway at the actual time of entry will be deemed to be the entrant and must comply with these rules in the event of a dispute as to entries submitted by multiple users having the same e-mail address. The authorized account subscriber is the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail addresses. No greater than the seven (7) prizes stated in these Official Rules will be awarded. If any technical errors occur in the selection of a potential winner or if more prizes are claimed than the number of prizes being awarded as provided in these Official Rules, we may award the prizes by random drawing from among all eligible claimants.

10. Miscellaneous

The Giveaway is governed by the laws of the United States. By entering the Giveaway, you as entrant agree (for yourself and your heirs) that The Berrics and each of their respective affiliates and agents, and the Promotion Entities involved in any aspect of this Giveaway (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Giveaway. Nothing in these Rules shall seek to limit or exclude liability on behalf of any of the Released Parties for death or personal injury caused by negligence or fraudulent misrepresentation. Entrants agree that Sponsor‘s decisions related to the Giveaway and all drawings are final. Winner agrees that, by participating in the Sweepstakes, Sponsor may use the winner’s name, image or likeness in any manner and in any medium for Sponsor‘s promotional purposes without additional compensation, except where prohibited by law.
